Privacy Policy

This Privacy Policy governs the processing of personal data of visitors to the website constantepro.com and has been prepared in accordance with the EU General Data Protection Regulation (Regulation (EU) 2016/679, hereinafter “GDPR”), the Spanish Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”) and Spanish Law 34/2002 on Information Society Services and Electronic Commerce (“LSSI-CE”).

What data we collect

Depending on your interaction with the website, we may collect the following categories of data:

Source of the data

All personal data is provided by you voluntarily — through the contact form, by email, by phone, or via messaging apps (WhatsApp, Telegram). We do not obtain your data from third parties.

  • To prepare estimates and commercial proposals.
  • To perform contracts for renovation and custom furniture works.
  • To issue invoices and comply with accounting and tax obligations.

  • Consent (Art. 6.1.a): for submission of data through the contact form and for the use of analytics or marketing cookies.
  • Performance of a contract (Art. 6.1.b): for the provision of requested services and preparation of estimates.
  • Legal obligation (Art. 6.1.c): for compliance with Spanish tax, accounting and consumer protection law.
  • Legitimate interest (Art. 6.1.f): the legitimate interest consists in protecting the technical integrity of the site against abuse, preventing fraud and understanding overall page performance. You may request a summary of the balancing test by writing to the email address above.

Retention periods

  • Enquiries via the contact form and correspondence: up to one year from the last contact, after which the data is deleted.
  • Client data and contractual documentation: for the duration of the contract and thereafter in accordance with the Spanish Commercial Code (general retention period for commercial documentation — 6 years, Article 30).
  • Invoices and tax documentation: minimum 4 years pursuant to Article 66 of the Spanish General Tax Law 58/2003.
  • Social Security contribution records: 4 years (TRLISOS, Royal Legislative Decree 5/2000, Art. 4.2).
  • Technical documentation of renovation works: for the liability periods established in Law 38/1999 on Building Regulations (1, 3 and 10 years depending on the type of defect) and, in any case, the general 5-year statute of limitations for personal claims (Art. 1964 of the Spanish Civil Code).
  • Cookies: as set out in the Cookie Policy below.

Recipients of the data

Your data is not sold or transferred to third parties for advertising purposes. The following may have access to the data:

  • The hosting provider of the website, located within the European Union — under a data processing agreement in accordance with Article 28 of the GDPR. The name of the provider may be supplied on request.
  • Spanish public authorities (Tax Agency, General Treasury of the Social Security, consumer protection authorities), where required by law.
  • Professional advisers (gestor — Spanish administrative consultant — accountant, tax advisor, lawyer), bound by professional secrecy.

International transfers

The website uses Google Fonts; when pages first load, your IP address may be transmitted to Google LLC (USA). Google LLC is certified under the EU-U.S. Data Privacy Framework (European Commission Adequacy Decision of 10 July 2023). As a supplementary safeguard, Google services are also governed by the EU Standard Contractual Clauses. We do not perform any other personal data transfers outside the European Economic Area.

Your rights

Under Articles 15 to 22 of the GDPR and the LOPDGDD, you have the following rights:

  • Access — obtain a copy of your personal data in our possession.
  • Rectification — request the correction of inaccurate or incomplete data.
  • Erasure (“right to be forgotten”) — request the deletion of your data where there is no legal basis for its retention.
  • Restriction of processing — restrict processing in certain situations.
  • Objection — object to processing based on legitimate interest.
  • Data portability — receive your data in a structured, machine-readable format.
  • Withdrawal of consent — withdraw previously given consent at any time (without affecting the lawfulness of processing based on consent before its withdrawal).
  • Not to be subject to automated decision-making — we do not apply automated decision-making or profiling with legal effects.

We may request additional information to verify your identity where there are reasonable doubts as to it (Art. 12.6 GDPR). We will respond within one month (extendable to two months in complex cases, of which you will be informed separately).

Right to lodge a complaint

Data security

We apply technical and organisational security measures in accordance with Article 32 of the GDPR: HTTPS encryption, access controls, regular backups and supervision of the hosting environment. Nevertheless, the transmission of information over the internet cannot be guaranteed to be entirely secure.

We reserve the right to update this Privacy Policy to reflect changes in legislation or our activity. The date of last update appears at the foot of the page. We recommend reviewing the current version periodically.
